The present General Terms and Conditions of Sale (GTC) are intended to define the rules applicable to the sale of products on the website www.rive-claire.com between

Any natural person of full age, not a trader, having the legal capacity to contract, exclusively domiciled in the countries (see list point 5 – Delivery and shipping costs) delivered by www.rive-claire.com (hereinafter the "customer") making a purchase of product on the site.

The site is hosted by Shopify Inc, 150 Elgin Street, Suite 800, Ottawa, Ontario, K2P 1L4, Canada.

The applicable GTC are those in force on the site at the date of the order placement by the customer, it being specified that any order of a product offered on the site implies the full and entire adhesion of the customer to the GTC in force at the time of the order placement.

1 - Products

The products offered for sale are those described on the site on the day of the customer's consultation and within the limits of available stocks.

Each product is the subject of a description sheet containing various information such as the photograph, price, sizes, dimensions and colors available, composition (non-exhaustive list). This information is updated regularly, it is however possible that errors may appear on the site, in which case the seller cannot be held responsible.

2 - Prices

The prices displayed on the site are indicated in Euros (€) and including value added tax (VAT), but excluding delivery charges, customs, or any other tax.

The prices invoiced are those in force at the time of the validation of the order.

Delivery charges are communicated to the customer on the order summary before the validation of the order and are expressed all taxes included. These costs are the responsibility of the customer and are invoiced in addition to the sale price of the products. The transfer of the risks of loss and deterioration of the products will be carried out after delivery and reception of the products by the customer.

The seller reserves the right to modify the prices indicated on the site at any time, but undertakes to apply the prices in force indicated to the customer at the time of validation of the order.

If an erroneous price appears for any reason (computer problem, human or technical error), the order, even if validated by the seller, will be cancelled. The customer will then be informed as soon as possible and will be offered the possibility of placing a new order at the exact original price defined by the seller.

3 - Online ordering process

The order taking is done by following the 7 next steps:

Step 1: create your customer account or indicate your username and the associated password.

Step 2: add the selected product(s) to your shopping cart. Access to the cart remains possible at any time for modification or validation of the order.

Step 3: validate your cart after having checked its contents and price.

Step 4: access your account to confirm and complete the necessary delivery information. If the customer does not already have an account on the site, it will be necessary to create his customer account and fill in the required information regarding his identity.

Step 5: on the order summary page, expressly accept the general terms and conditions of sale (GTC) of the site.

Step 6: the customer will then be redirected to the secure online payment site to validate the payment. The customer's definitive acceptance is therefore formalized by the validation of his bank details (credit card number, expiry date and cryptogram). The placing of an order by the customer implies the latter's full and unreserved acceptance of these general terms and conditions of sale (GTC).

Step 7: after acceptance of payment, the order is confirmed and the customer receives an email confirming his order including the registration of the order, the details of the items ordered, the personal data including address and delivery method.

To follow the progress of the order processing, the customer must go to "My Account" on the website www.rive-claire.com. After identification, the customer will be able to check the status of his orders.

The seller reserves the right not to honor an abnormal order or an order made in bad faith, as well as for any other legitimate reason.

The seller can only accept orders within the limits of available stocks. At the time of ordering on the site, the seller informs the customer of the availability of the products. If, despite its vigilance, a product proves to be unavailable, the seller will inform the customer by email as soon as possible. The latter could cancel his order and be refunded the amount already paid. The temporary or permanent unavailability of the ordered products shall in no case engage the responsibility of the seller, nor shall it give rise to any right to compensation or damages in favor of the customer.

4 – Payment

The seller has set up the 3D-Secure secure payment system for all orders placed on the site www.rive-claire.com.

The payment of the customer's purchases is made immediately, when the order is placed, by credit card (Credit card, Visa, Eurocard/Mastercard). Payment is made directly and immediately online and in Euros.

The seller remains the owner of the items sold until full payment of the price, VAT, shipping costs and any customs duties.

5 – Delivery and shipping costs

The customer will be informed by email when his order is picked up with the tracking number of the package. The shipping costs are automatically calculated at the end of the order depending on the place of delivery.

Free delivery at home or to a Point Relais in metropolitan France and Switzerland from 300€ of purchase.

For France and Switzerland, delivery is made within 4 to 6 working days upon receipt of order. We use Colissimo with tracking delivered with signature at home and Point Relais for France and the Swiss Post for Switzerland.

For deliveries outside France and Switzerland and to Europe, the standard shipping method is Colissimo with tracking and delivered at home with signature.

Delivery cannot be made to hotels or post office boxes.

Home delivery with Colissimo with tracking and signature in 4 to 15 working days: 15,00€.
No delivery in Point Relais available.
No delivery will be made outside this list of countries.

For shipments outside the European Union (EU), customs fees may apply and are usually charged upon arrival of the package in the destination country. The customer must imperatively pay them in order to receive his package. These fees are neither applied nor collected by the seller, they are therefore non-refundable and the seller cannot in any way estimate the amount of the customs fees, as they vary from one country to another. Outside the territory of the EU, it is important to note that delivery may be delayed or blocked until the formalities and customs fees have been paid by the customer, which he expressly accepts. Refusal by the customer to pay the customs fees will result in the cancellation of the order. Any transport and customs charges paid by the seller to recall the order shall be borne by the customer.

6 – Retention of title

The seller retains full and complete ownership of the products sold until full payment of the total price, including fees, taxes and possible customs duties.

7 – Returns and withdrawal right

The customer has a right of retraction that he can exercise, without having to justify his reasons, within fourteen (14) calendar days from receipt of the products ordered.

The product(s) must be returned in their original condition and complete (including packaging and label) and accompanied by a copy of the documents attached to the order (purchase invoice).

The return costs are at the customer's expense. Any product that has been used or damaged will not be refunded, taken back or exchanged. In the event of exercising the right of retraction, the customer has the choice of requesting either a refund of the sums paid or an exchange of the product. In the event of exercising the right of retraction, the seller will make every effort to reimburse the customer within fifteen (15) days.

Refunds will be made by credit card to the same credit card used for payment. In the case of a refund, the return costs shall be borne by the customer.

8 – Liability

Upon delivery of the order, the customer undertakes to check the conformity and the state of his order and to issue, if necessary, all the useful reserves concerning the apparent defects (missing product, damaged package etc...).

The goods are transported under the customer's responsibility. The latter must refuse a package with anomalies or a presentation that could suggest a partial or total deterioration of the goods or theft.

The customer undertakes to declare by email to hello@rive-claire.com or by any other written means a possible error, anomaly or defect concerning the items received and this within 48 hours of receipt of the package, specifying the order number and the subject of the complaint.

9 – Warranty

The seller guarantees the quality of the products sold, to the preparation of which the greatest care is taken. However, he cannot be held responsible for damages of any kind that may result from the misuse of the products.

10 – Intellectual property rights

All the elements of the site are and remain the intellectual and exclusive property of the seller. The user is not authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text.

11 – Confidentiality and data protection

All personal data will be treated as confidential. The information necessary for the management of the order will be subject to computer processing and may be communicated to associated companies as part of the management of the order.

The customer is informed that the collection of his personal data is necessary for the sale of the products and the delivery / delivery, entrusted to the seller. These personal data are collected solely for the execution of the sales contract.

In accordance with the provisions of Law No. 78-17 of January 6, 1978 and European Regulation 2016/679 relating to data processing, files and freedoms, the customer has a right to access, modify, rectify and delete data concerning him.

The customer can subscribe to the Rive Claire newsletter and thus choose to be regularly informed of the offers proposed by the brand. He has, at any time, the possibility to unsubscribe by clicking on the link provided for this purpose on each of the newsletters.

12 – Final provisions / Disputes

Swiss law applies to these General Terms and Conditions (GTC). In the event of persistent disagreement on the application, interpretation and execution of the present terms and conditions, and in the absence of an amicable agreement, any dispute shall be subject to the competent Swiss courts.
